These Nanotech Computers Terms and Conditions govern your use of our website at www.nanotech-computers.com or our mobile apps (collectively, the “Services”). In-App Purchases

Our apps offer virtual items and currencies that can be purchased through Apple’s In-App Purchase (IAP) system. All purchases are final and non-refundable, except where required by law or at our discretion. Prices and availability of virtual items may change without prior notice.

Virtual Currency and Rewards

The apps may include virtual currencies (such as coins) which are licensed to you and have no monetary value outside of the apps. You acknowledge that you do not own these virtual items, and they are not redeemable for real-world currency. We reserve the right to modify, manage, control, or eliminate virtual currency at our discretion without liability.

Advertisements and Third-Party Services

Our apps may display advertisements delivered by third-party networks like Google AdMob. We are not responsible for the content, accuracy, or reliability of any advertisements or third-party services. Interactions with advertisers or third-party services, including any payment or delivery of goods or services, are solely between you and the third party.

Limitation of Liability

To the maximum extent permitted by law, Nanotech Computers shall not be liable for any indirect, incidental, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use or inability to use the app. The app and its services are provided on an “as-is” and “as-available” basis without any warranties.

Dispute Resolution

Any disputes or claims arising from these Terms will first be attempted to be resolved informally by contacting us. If not resolved within 30 days, disputes shall be referred to and finally resolved by arbitration under the rules of the Arbitration Foundation of Southern Africa (AFSA).
  The arbitration shall take place in South Africa, in English.

Disclaimers and Limitations of Liability

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, TO THE EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
TO THE EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL NANOTECH COMPUTERS (PTY) LTD OR ITS AFFILIATES BE LIABLE FOR ANY DIRECT, SPECIAL, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

This limitation of liability does not apply to damages caused by our gross negligence or wilful misconduct.

Indemnification

You agree to indemnify and hold harmless Nanotech Computers (Pty) Ltd and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your use of the Services or any violation of these Terms by you.

Termination

We may terminate or suspend your access to the Services at any time, with or without cause, and with or without notice. Upon termination, you must cease all use of the Services.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising out of or in connection with these Terms or the Services shall be resolved through the courts of South Africa.

If you are using any of our mobile apps, the following additional terms apply:

• The app is provided “as is” without any warranties of any kind.
• You acknowledge that Apple, and its subsidiaries, are third-party beneficiaries of these Terms and that, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.
• You must comply with all applicable third-party terms of agreement when using the app.
